Terms and Conditions

Article 1 – Definitions

In these terms and conditions, the following definitions apply:

  • Cooling-Off Period: The period during which the consumer may exercise their right of withdrawal.
  • Consumer: A natural person not acting in the exercise of a profession or business who enters into a remote agreement with the entrepreneur.
  • Day: Calendar day.
  • Ongoing Agreement: A remote agreement concerning a series of products and/or services where the delivery and/or purchase obligation is spread over time.
  • Durable Data Carrier: Any tool that enables the consumer or entrepreneur to store information directed personally to them in a way that makes future reference and unchanged reproduction possible.
  • Right of Withdrawal: The option for the consumer to cancel a remote agreement within the cooling-off period.
  • Entrepreneur: The natural or legal person who offers products and/or services remotely to consumers.
  • Remote Agreement: An agreement where, within the scope of a system organized by the entrepreneur for the remote sale of products and/or services, only one or more techniques for remote communication are used until the conclusion of the agreement.
  • Technique for Remote Communication: A means that can be used to conclude an agreement without the consumer and entrepreneur being in the same space at the same time.
  • General Terms and Conditions: These General Terms and Conditions of the entrepreneur.

Article 3 – Applicability

  1. These general terms and conditions apply to every offer from the entrepreneur and every remote agreement and order between the entrepreneur and the consumer.
  2. Before a remote agreement is concluded, the text of these terms and conditions will be made available to the consumer. If this is not reasonably possible, the entrepreneur will indicate, before concluding the agreement, how the terms and conditions can be reviewed and that they will be provided free of charge upon request.
  3. If the agreement is concluded electronically, these terms and conditions may also be provided electronically in a way that allows the consumer to store them for future reference.

Article 4 – The Offer

  1. If an offer has a limited validity period or is subject to conditions, this will be explicitly stated.
  2. The offer is non-binding. The entrepreneur reserves the right to modify the offer.
  3. The offer includes a complete and accurate description of the offered products and/or services. Images are a true representation of the products, but slight variations (e.g., color differences) may occur.
  4. Each offer clearly states:
    • The price, including taxes.
    • Delivery costs (if applicable).
    • Payment, delivery, and contract fulfillment methods.
    • The right of withdrawal (if applicable).

Article 5 – The Agreement

  1. The agreement is concluded when the consumer accepts the offer and meets the stated conditions.
  2. If the consumer accepts the offer electronically, the entrepreneur will immediately confirm receipt of acceptance electronically.

Article 6 – Right of Withdrawal

  1. Consumers may cancel a product purchase within 14 days without giving a reason. The cooling-off period starts the day after the product is received.
  2. During the cooling-off period, the consumer must handle the product and packaging with care. The product can only be inspected as necessary to decide whether to keep it.

Article 7 – Costs in Case of Withdrawal

  1. The consumer bears the return shipping costs when exercising their right of withdrawal.
  2. The entrepreneur will refund the purchase amount, including standard delivery costs, within 14 days after withdrawal, provided the product is returned in its original condition.

Article 8 – Exclusion of the Right of Withdrawal

The right of withdrawal does not apply to:

  • Custom-made products.
  • Products that cannot be returned for hygiene reasons once unsealed.

Article 9 – Pricing

  1. Prices include taxes.
  2. During the offer's validity, prices will not increase, except for changes in VAT rates.

Article 10 – Warranty and Conformity

The entrepreneur ensures that products and services comply with the agreement, specifications, and reasonable usability requirements.


Article 11 – Delivery

  1. Products will be delivered to the address provided by the consumer.
  2. Delivery will occur within 30 days unless otherwise agreed.

Article 12 – Termination of Ongoing Agreements

  1. Consumers can terminate ongoing agreements with a notice period of one month.

Article 13 – Payment

  1. Payments must be completed within 7 days unless otherwise agreed.

Article 14 – Complaints

  1. Complaints must be submitted within 7 days of discovering the issue.
  2. Complaints will be addressed within 14 days.

Article 15 – Disputes

  1. These terms and conditions are governed by Australian law.
